Abstract | : | This research entitle "Good Faith in Theraupetic Transaction" that have Purpose to investigating the implementation of good faith in theraupetic transaction and the juridical implication if the theraupetic transaction not being based on good faith and also the possibility of notary involyement in the making of therauPetic transaction. This is a juridical normatiye rcsearch. It is juridical as the research approaches the problems by studying the legal principles, doctrines, and requirements. And normative as the research highlighX on the document studies, including theories and other library sources. To completnent the slcondary data, field research is conducted subsequently. Based on the analysk, the good faith on pre-contractual stage is perceived as honesty. Anest H.R dated 15 Noyember 1957 stipulates an obligation to perforrn checking and announcement. Based on the analysed doctrines and jurisprudence, the measurement of the good faith in theraupetic transaction lies on the information supply of medical measures along with its potential risks before the execution of medical practices by the doctor. If the theraupetic transaction not being based on good faith, it is possible to abuse the circumstance and to terminate the transaction. Notary, in the case of theraupetic transaction, is possibly being asked for involvement. The role of the notary is creating afi authentic deed. The mutually-agreed requests of rehted parties are written into such authentic deeil. An quthentic deeil acts as impeccable evidence to the related parties, providing legal protection particularly to the medical measures that is high-risk. |
