| Abstract | : | This research aims to understand and analyze fulfillment of elements of paragraph 4(a)-(c) UDRP in trademark v. domain names cases by the WIPO Arbitration and Mediation Center. The method of this research is juridical normative through library research. Source of data is taken from primarily, secondary, and tertiary legal sources. This research uses documentary study and data were analyzed by qualitative method. Based on the research, it is conclusive that the implementations of UDRP i.e. the implementation of elements of paragraph 4(a)-(c) of UDRP is parallel with the paragraph and it has been greatly implemented consistently by the WIPO Arbitration and Mediation Center. The implementation creates legal protection and legal certainty for parties; complainant of the cases and respondents who have good faith in registering their domain names. The implementation shows the careful handling of cases by panelists of the WIPO Arbitration and Mediation Center. The decisions fulfill the principle of fairness, impartiality and create balance of interests between trademark holder and domain name user. |
